In the present article, the authors make an analysis of the importance of the precedent of mandatory observance in relation to the scope of article 5 of the Regulation of Environmental Protection of Mineral-Metallurgical Activities and its relation with the interpretative rules of Peruvian Law, especially the Principle of Typicity.En el presente artículo, los autores realizan un análisis de la importancia del precedente de observancia obligatoria en relación a los alcances del artículo 5 del Reglamento de Protección Ambiental de las Actividades Minero-Metalúrgicas y su relación con las reglas interpretativas del Derecho Peruano en especial el Principio de Tipicidad.
