| Description | This article analyzes the legal regime of the foreign investment and its impact in the national economic development. There is a serious legal inconsistence between the national law and the international treaties, where the simulation, piramidacion and intermediation are practices to elude the limits and percents as defined by law. The discretion in the application of the Law —particularly in the cases of “sectorial openings” and “neutral investment”—, represents a mechanism that reveals legal incompatibilities. | Description | Se analiza el régimen jurídico de la inversión extranjera y su impacto en el desarrollo económico nacional. Existen serias incongruencias legales entre la norma nacional y los tratados, donde la simulación, piramidación e intermediación son prácticas para eludir los límites y/o porcentajes que por ley se definen. La discrecionalidad en la aplicación de la Ley, particularmente en lo relativo a la “apertura sectorial” y la de “inversión neutra” son mecanismos que enfatizan las incompatibilidades jurídicas existentes. Asimismo, se demuestra que los tratados no han funcionado adecuadamente en materia de promoción y de protección de las inversiones. | es-ES |
