In “Contract Law and Distributive Justice”, Anthony Kronman argues that the voluntary basis of contracts should be conceived wholly in terms of a conception of distributive justice. In this essay, my aim is to cast doubt on Kronman´s distributive thesis. Its main problem is that, under Kronman´s distributive thesis, contracts become a mere instrument for the promotion of distributive justice. My claim is that, given the focus on distributive justice, Kronman’s distributive approach cannot explain neither the privity rule nor the central role of consent in contract law.En “Contract Law and Distributive Justice”, Anthony Kronman sostiene que la voluntariedad en los contratos debe entenderse completamente en base a una concepción de la justicia distributiva. En este ensayo me propongo cuestionar la tesis distributiva de Kronman. El problema central de tal tesis es que entiende a la interacción contractual entre las partes meramente como un medio para promover la justicia distributiva. Mi tesis es que, por tal razón, tal teoría no da cuenta de algunos aspectos centrales del derecho de los contratos tales como el efecto relativo de los contratos y el rol central del consentimiento.
