DescriptionOn the Practical Grounds of Punishment in Immanuel Kant Kant’s theory of punishment has been studied without any further consideration of the wider philosophy that grounds it. In this article, I will seek to make explicit Kant’s theoretical/philosophical grounding of the theory. I will intend to exhibit how Kant deduces the categorical character of criminal law from the Principle of Right and the categorical imperative. This theoretical grounding of the categorical character of punishment will hold only insofar as it is possible to understand why Reason is capable of imposing categorical principles of action—i.e. duties—to itself.en-US
DescriptionLa teoría de la pena ideada por Kant suele ser estudiada sin consideración del marco filosófico que le da sentido y fundamentación. La intención del presente trabajo es explicitar la fundamentación teórico-filosófica que sostiene a dicha teoría de la pena. Me propongo exhibir cómo Kant deriva el carácter categórico de la ley penal a partir del principio del Derecho y del imperativo categórico. Esta fundamentación teórica del carácter categórico de la pena se sostendrá en tanto podamos comprender en qué sentido y por qué la razón es capaz de imponerse a sí misma principios categóricos de acción, es decir, deberes.es-ES
