| Description | The Problem of Facts in the Justification of Judicial Decisions This paper presents an argument to support the claim that the descriptive propositions about the facts of the case, which are an ordinary component of contemporary judicial decisions, must meet a truth requirement. This requirement is, therefore, a criterion of justification of judicial decisions. To build the argument, the article resorts to the analysis of the concepts of “judicial decisions”, “application” of general norms and “normative justification”. In addition, it reviews several forms of kelsenian skepticism on the truth requirement and holds that they fail. | en-US |
| Description | Este trabajo presenta un argumento en favor de la exigencia de verdad de las proposiciones descriptivas de los hechos en controversias que normalmente integran el contenido de las sentencias en el derecho contemporáneo. Esta exigencia es, de este modo, un criterio de justificación de las decisiones judiciales. Para desarrollar el argumento se recurre al análisis de las nociones de “decisión judicial”, de “aplicación” de normas generales y de “justificación normativa”. Se revisan, asimismo, diversas formas del escepticismo kelseniano acerca de esa exigencia de verdad y se sostiene que no son exitosas. | es-ES |
