The objective of this work is to reflect on the gender stereotypes included in the argument, based on the use of the gender perspective, which will reveal that by using these preconceptions about women (characteristics, attributes and roles) the judiciary makes explicit the patriarchal pact, but at the same time through the motivations that justify a decision they can collaborate in the eradication of gender stereotypes.El presente trabajo tiene como objetivo reflexionar sobre los estereotipos de género incluidos en la argumentación, a partir del uso de la perspectiva de género, que permitirá develar que mediante la utilización de estas preconcepciones sobre las mujeres (características, atributos y roles) la judicatura hace explícito el pacto patriarcal, pero al mismo tiempo por medio de las motivaciones que justifican una decisión pueden colaborar en la erradicación de los estereotipos de género.
