En medio de una gravísima crisis sanitaria y de una situación excepcional sin precedentes en la historia reciente causada por la pandemia de la COVID-19, miles de migrantes siguen muriendo en las aguas del Mediterráneo en su intento de llegar a Europa buscando nuevas oportunidades, tras huir de la violencia, la guerra y los conflictos armados. Este trabajo pretende reflejar, mediante una revisión jurisprudencial, algunas de las distintas vulneraciones del Derecho Internacional Humanitario y de los Refugiados que han tenido lugar tanto en el territorio español como el europeo durante los últimos años.In the midst of a very serious health crisis and an exceptional situation unprecedented in recent history caused by the pandemic, thousands of migrants continue to die in the waters of the Mediterranean in their attempt to reach Europe in search of new opportunities, after fleeing violence, war and armed conflict. This paper aims to reflect, through a jurisprudential review, some of the different violations of International Humanitarian and Refugee Law that have taken place in both Spanish and European territory in recent years.
