En este artículo se verificará la vigencia del modelo de Estado social de Derecho en el siglo XXI ante los señalamientos de crisis que denuncian su ineficacia y proponen su desmantelamiento. La verificación se realizará tomando como punto de partida el origen político-ideológico del modelo así como las razones de su constitucionalización, teniendo en cuenta que el modelo de Estado social es producto de sus circunstancias históricas. Por ello, aquí se plantea su evolución hacia un Estado social con enfoque desarrollista, el cual dé respuesta a la nueva “cuestión social” e incluyendo una nueva forma de entender la justicia. doi: http://dx.doi.org/10.20318/universitas.2016.3176This paper will verifies the force of the model of Social State of Law in the XXI century facing the assignment of crisis that announces its inefficacy and proposes its dismantling. This verification will be realized taking as a starting point the political-ideological origin of the model as well as the reasons of its constitutionalization, keeping in mind the model of Social state is product of its historic circumstances.
