Nordic countries like Denmark, Finland, Sweden, Norway and Iceland, with highly developed welfare states, are at the head of the existing rankings in terms of Corporate Social Responsibility (CSR) and sustainability. In addition to its high level of awareness, their companies, beyond the mere creation of economic value, they seek to maximize the welfare of the whole society, investing today in the development of future activity without compromising the needs of future generations. Spain, halfway between the voluntary adoption of CSR strategies and the need for regulation of minimum, addresses today the implementation of a plan that includes concrete measures focused, following the Guiding Principles which reflect the current international law, the duty of the State to protect, the duty of corporate to respect and access to legal and other redress mechanisms, and which conditions any support from the Government to respect human rights by those companies that request it. The present study is national HR policies and will consider the need for a new International Treaty on Business and Human Rights on the world stage. But it should hold, within the analysis proposed here, on the one hand, the voluntary initiative of the State Government to develop Business Plans and Human Rights (HR) and CSR; and, second, that the framework is to respect the established global or international level; if we want to understand the willingness of some countries and the neglect of others; and their policies governments, CSR.Países Nórdicos como Dinamarca, Finlandia, Suecia, Noruega e Islandia, con Estados del bienestar muy desarrollados, se sitúan a la cabeza de los rankings existentes en cuanto a Responsabilidad Social Corporativa (RSC) y sostenibilidad. Además de su alto grado de concienciación, sus empresas, más allá de la mera creación de valor económico, buscan maximizar el bienestar del conjunto de la sociedad, invirtiendo hoy en el desarrollo de su actividad futura sin comprometer las necesidades de las próximas generaciones. España, a medias entre la adopción voluntaria de estrategias de RSC y la necesidad de una regulación de mínimos, aborda hoy la implementación de un Plan que recoge medidas concretas centradas, siguiendo los Principios Rectores que recogen el Derecho Internacional vigente, en el deber del Estado de proteger, la obligación de las empresas de respetar y el acceso a los mecanismos judiciales y extrajudiciales de reparación, y que condiciona cualquier tipo de apoyo del Gobierno al respeto a los derechos humanos (DDHH) por parte de aquellas empresas que lo soliciten. El presente estudio trata de políticas Nacionales y se planteará sobre la necesidad de un nuevo Tratado Internacional sobre DDHH y empresas multinacionales. Sin embargo, dentro del análisis que aquí se propone, cabe retener por una parte, la iniciativa voluntaria de los Gobiernos para elaborar Planes Estatales de Empresa y DDHH, y de RSC; y, por otra, que el marco a respetar es el establecido a nivel global o Internacional. Si queremos comprender la disposición de unos países y la inacción de otros. Y las políticas de sus Gobiernos, en materia de RSC.
