DescriptionLa capacidad de las escuelas concertadas de seleccionar al alumnado más aventajado socioeconómicamente es una de las causas que explican la creciente segregación escolar en España. A pesar de que la educación obligatoria se debe impartir gratuitamente, para garantizar la libertad de elección de centro de todas las familias, está extendido el cobro de las denominadas «cuotas voluntarias», que se justifican por la oferta de actividades complementarias. La ambigüedad de los preceptos que regulan dichas actividades se hizo patente durante el estado de alarma a raíz de la pandemia de COVID-19. Por ello, regiones como la Comunidad de Madrid oCataluña se apresuraron a promulgar medidas que garantizaran la voluntariedad real de estasactividades y/o la equidad en el acceso con independencia de la capacidad socioeconómica delas familias. Este trabajo pretende explicar por qué, paradójicamente, intentar garantizar lavoluntariedad e incluso la gratuidad de dichas actividades nos alejan del objetivo de lograr unsistema educativo justo.es-ES
DescriptionThe ability of charter schools to select the most socio-economically advantaged students is one of the reasons for the growing school segregation in Spain. Even though compulsory education must be provided free of charge, in order to guarantee freedom of choice for all families, the charging of so-called «voluntary fees» is widespread. These are justified by the provision of complementary activities. The ambiguity of the precepts regulating such activities became apparent during the state of alarm caused by the COVID-19 pandemic. As a result, regions such as the Community of Madrid or Catalonia rushed to enact measures to guarantee the real voluntary nature of these activities and/or the equity regardless of the socio-economic capacity of the families. This paper aims to explain why, paradoxically, trying to ensure that these activities are voluntary and even free of charge moves us away from the goal of achieving a fair educational system.en-US
