Nature is currently recognised as a subject of law by the Ecuadorian Constitution of 2008. However, animals have yet to be given the legal status they deserve despite the fact that it has been scientifically proven that animals have the capacity to express their feelings and empathise, whilst inhabiting an environment alongside human beings on a day-to-day basis. We must take into consideration that there is currently no Animal Protection Law in place in Ecuador but neighbouring countries, such as Colombia and Peru, do have one. The project of Organic Law of Animal Welfare (LOBA) will be able to raise awareness for the defence and rights of animals and consequently reform art. 585 of the Ecuadorian Civil Code, in which animals are considered to be objects that move by themselves. These changes could eliminate animal cruelty and make sure that people think carefully before any act that could produce pain for these vulnerable creatures.La Naturaleza está actualmente reconocida como sujeto de derecho por la Constitución ecuatoriana de 2008. Sin embargo, a los animales aún no se les ha otorgado el estatuto jurídico que merecen a pesar de que se ha demostrado científicamente que tienen la capacidad de expresar sus sentimientos y sentir empatía, mientras diariamente habitan en un entorno junto con los seres humanos. Debemos tener en cuenta que actualmente no existe una Ley de Protección de los Animales en Ecuador si bien países vecinos, como Colombia y Perú, sí disponen de ella. El proyecto de Ley Orgánica de Bienestar Animal (LOBA) permitirá crear conciencia sobre la defensa y los derechos de los animales y, en consecuencia, reformar el art. 585 del Código Civil ecuatoriano, en el que los animales son considerados objetos que se mueven por sí solos. Estos cambios podrían eliminar el maltrato animal y garantizar que las personas piensen cuidadosamente antes de realizar cualquier acto que pueda producir dolor a estas criaturas vulnerables.
