This critical analysis presents a case for current inadequacy of legislation protecting the welfare of wild animals used in travelling circuses in England. The Licensing Scheme, that is currently in effect, can never guarantee the welfare of wild animals used by circuses, given both the nature of the circus as a stressful environment, and the natures of the wild animals that, in such conditions, are limited in carrying out typical social habits and motivated behaviours. Only the implementation of the Wild Animals in Circuses Bill and the total ban that it entails can guarantee adequate welfare protection for wild animals. Scotland is currently in the process of implementing its own draft bill banning the use of wild animals in travelling circuses – just one of their many political actions in the interests of animal welfare. While in England a legislative Bill banning the use of animals has been drafted and should be ready for implementation, its coming into effect has been postponed until there is sufficient time in the Parliamentary agenda. The author remains sceptical as to how soon, or if at all, the ban will come about in the foreseeable future.Este análisis crítico proporciona un argumento para la insuficiencia de la legislación que protege el bienestar de los animales salvajes, utilizados en circos que se desplazan de viaje por Inglaterra. El Régimen de Licencias, actualmente en vigor, nunca puede garantizar el bienestar de los animales salvajes utilizados por los circos, dada la naturaleza del circo como ambiente estresante y la naturaleza de los animales salvajes que viven en tales condiciones, pues no pueden desarrollar sus hábitos sociales típicos y sus propios comportamientos motivados. Sólo la implementación del Wild Animals in Circuses Bill (Proyecto de Ley sobre los animales salvajes en los circos) y la prohibición total que ello conlleva pueden garantizar una protección adecuada del bienestar de los animales salvajes. Escocia está actualmente en proceso de implementar su propio proyecto de ley que prohíbe el uso de animales salvajes en circos de viaje - una de sus muchas acciones políticas en interés del bienestar animal. Mientras que en Inglaterra se ha redactado un proyecto de ley que prohíbe el uso de animales y debe estar listo para su implementación, su entrada en vigor se ha pospuesto hasta que haya tiempo suficiente en la agenda parlamentaria. El autor sigue siendo escéptico en cuanto a cúando, o en todo caso, si la prohibición se producirá en un futuro previsible.
