Description“Democracy” must be understood constitutionally not only as a juridical structure and a political regime, but as a system of life founded on the constant economic, social and cultural improvement of the people. However, a century later, Modernity, «legal positivism» and the whole legal tradition of which we are heirs —often unreflective— have generated a democratic or consensus axiology, thus producing what today we can call “empty democracy”. Such circumstance becomes evident with the issuance of the Decree that contained the first part of the electoral “Plan B” and which was subject of analysis by the Mexican Supreme Court of Justice when resolving the action of unconstitutionality 29/2023 and its accumulated ones.en-US
DescriptionLa “democracia” debe comprenderse constitucionalmente no solamente como una estructura jurídica y un régimen político, sino como un sistema de vida fundado en el constante mejoramiento económico, social y cultural del pueblo. Sin embargo, a un siglo de distancia, la Modernidad, el “positivismo jurídico” y toda la tradición jurídica de la que somos herederos —muchas veces irreflexivos— ha generado una axiología democrática o de consenso, produciendo así lo que hoy podemos denominar como “democracia vacía”. Tal circunstancia, se pone de manifiesto a la luz de la expedición del Decreto que contenía la primera parte del “Plan B” electoral y que fue materia de análisis por parte de la Suprema Corte de Justicia de la Nación (SCJN) al resolver la acción de inconstitucionalidad 29/2023 y sus acumuladas.es-ES
