DescriptionIn the present work, the legal phenomenon of constitution substitution is studied, which occurs when a defining element of the essence of the 1991 Constitution, instead of being modified, is replaced by an opposite or entirely different one. In this vein, the substitution of the constitution is a figure created by the Constitutional Court of Colombia through ruling C-551 of 2003. Thus, the objective of the work is aimed at identifying the origin and development of the theory of substitution of the constitution in constitutional jurisprudence.en-US
DescriptionEn el presente trabajo se estudia el fenómeno jurídico de la sustitución de la constitución, el cual se presenta cuando un elemento definitorio de la esencia de la Constitución de 1991, en lugar de ser modificado, es reemplazado por uno opuesto o integralmente diferente. En este orden de ideas, la sustitución de la constitución es una figura creada por la Corte Constitucional de Colombia mediante la sentencia C-551 de 2003. Así pues, el objetivo del trabajo se orienta a identificar el origen y desarrollo de la teoría de la sustitución de la constitución en la jurisprudencia constitucional.es-ES
