DescriptionThis article analyzes the civil liability regime proposed in Chile’s Artificial Intelligence Bill, submitted to the Chamber of Deputies on May 7, 2024. This paper intends to analyze the civil liability regime proposed in Articles 28 and 29 of the Bill while assessing its compatibility with the supplementary regime of the Civil Code and other extra-contractual liability frameworks applicable to technology providers. The analysis focuses on the regulation of fault in the Project. The study suggests that, although innovative, the bill requires adjustments to avoid contradictions and improve clarity in its practical application, both nationally and in relation to international legal frameworks.en-US
DescriptionEste trabajo analiza el régimen de responsabilidad civil propuesto en el proyecto de ley de inteligencia artificial en Chile, presentado en la Cámara de Diputadas y Diputados el 7 de mayo de 2024. El enfoque es examinar y evaluar el régimen de responsabilidad civil propuesto en los arts. 28 y 29, evaluando su compatibilidad con el régimen supletorio del CC y otros marcos de responsabilidad extracontractual aplicables a proveedores de tecnología. El análisis se enfocará en los aspectos de imputabilidad definidos en el proyecto de ley. Se sugiere que la propuesta legislativa, aunque innovadora, requiere ajustes para evitar contradicciones y mejorar la claridad en su aplicación práctica.es-ES
