DescriptionLegal certainty accomplishes (among others) the function of being a general principle of our legal system, assuming a fundamental role in resolving so-called “difficult” cases. Since we start from the premise that difficult cases must be resolved considering the values and principles that support the civil institution involved, all those cases related to the statute of limitations must be interpreted in accordance with this general principle of law –and legal value– which undoubtedly serves it as a base. Faced with the particular and insistent question of whether the interruption of the statute of limitations requires the mere presentation of the claim or the legal notification of the same within the term, it is this principle the one that offers good reasons to opt for the second option.en-US
DescriptionLa seguridad jurídica cumple, entre otras, la función de ser un principio general de nuestro ordenamiento jurídico, asumiendo un papel fundamental en la resolución de los llamados casos “difíciles”. Como partimos de la premisa de que los casos difíciles deben ser resueltos a la luz de los valores y principios que sustentan la institución civil involucrada, todos aquellos que estén vinculados con la prescripción deben ser interpretados en concordancia con este principio general del derecho –y valor jurídico–, que, sin lugar a duda, le sirve de fundamento. Ante la particular e insistente interrogante de si la interrupción de la prescripción exige la sola presentación de la demanda o la notificación legal de la misma dentro del plazo, es este principio el que ofrece buenas razones para decantar por la segunda opción.es-ES
