DescriptionThis commentary contains a critical review of a decision by the Supreme Court about the kind of inefficacy applicable to contracts carried out by an agent whose mandate had expired. The Court concluded that the absolute nullity for lack of will should be applied, and not the unenforceability of the acts. At the same time, this commentary analyzes the omission in the decision regarding the application of the protection of good faith of third parties which is contained article 2173 of Civil Code. Finally, some projections are made about the place that the nullity and the unenforceability occupy inside of a general theory of ineffective contracts.en-US
DescriptionEl presente comentario revisa una sentencia emitida por la Corte Suprema en la cual se discutió acerca del tipo de ineficacia aplicable a los actos realizados por el mandatario cuyo mandato ha expirado, concluyendo aquella sentencia que correspondía declarar la nulidad absoluta por falta de voluntad y no la inoponibilidad de los actos. Al mismo tiempo, analiza la omisión que realiza la sentencia respecto de aplicar la protección que el art. 2173 del CC otorga a los terceros de buena fe. Finalmente contiene algunas proyecciones sobre el lugar que ocupa la nulidad y la inoponibilidad dentro de una teoría general de la ineficacia de los actos y/o contratos.es-ES
