The second decade of the 21st century marks the beginning of the most important state impulse that has been imposed on the national hydrocarbon industry. Modifications to the Constitution, a new regulatory framework and government planning supported by its use and, above all, the increase in the number of exploitation projects are the greatest testimony of this. This last corollary that accompanies the new impulse of the oil industry comes with effects that tend to impact on assets protected by human rights, such as water, which generates tensions around its guarantee. Therefore, the present academic work aims to examine the implications of the human right to water and the negative effects of the use of hydrocarbons that undermine its guarantee within the framework of the conventions established for this right.La segunda década del siglo XXI marca el inicio del impulso estatal más importante que se le ha impuesto a la industria nacional de los hidrocarburos. Modificaciones a la Constitución, un nuevo marco regulatorio, planeaciones gubernamentales soportadas en su aprovechamiento y, sobre todo, el acrecentamiento en el número de proyectos de explotación son el mayor testimonio de ello. Este último corolario que acompaña al nuevo impulso de la industria petrolera viene acompañado de efectos que repercuten sobre bienes tutelados por los derechos humanos, como el agua, lo que genera tensiones en torno a su garantización. Por lo anterior, el presente trabajo académico tiene como finalidad examinar las implicaciones del derecho humano al agua y los efectos negativos del aprovechamiento de los hidrocarburos que atentan contra su garantización en el marco de las convenciones instauradas para este derecho.
