DescriptionThe restrictions that Mexican jurisprudence has recently defined as to the judicial review can be interpreted as a throwback to the consolidation of the constitutional paradigm. In particular, the jurisprudential criteria analyzed show that the imperative to found and motivate is weakened and the direct interpretation of the Constitution is despised. This return to the past is criticized in this paper. To achieve this, first, the jurisprudential evolution of the judicial review is explained. Afterwards, we reflect on the implications of this control in the constitutionalizing process; this shows the positive and negative impact that this control has on that process; furthermore, in this context, the idea according to which this type of control fosters a “chaotic interpretivism” and encourages “unbridled judicial activism” is rejected. Finally, the criticism to the weakening of the imperative to found and motivate is highlighted because this practice not only affects the exercise of judicial review, it also conditions the viability of the constitutional paradigm.en-US
DescriptionLas restricciones al control difuso que recientemente ha delineado la jurisprudencia mexicana suponen un retroceso en la consolidación del paradigma constitucionalista. Particularmente, los criterios jurisprudenciales analizados muestran un debilitamiento del imperativo de fundar y motivar y un desprecio por la interpretación directa del texto constitucional. En este trabajo se critica esta vuelta al pasado. Para lograrlo, primero, se expone la evolución jurisprudencial del control difuso. Después, se reflexiona sobre las implicaciones de esta figura en el proceso de constitucionalización; con ello se muestra el impacto positivo y negativo que dicho control tiene en este proceso; además, en su oportunidad, se rechaza la idea según la cual este tipo de control propicia un “caótico interpretativismo” e impulsa un “desbocado activismo judicial”. Finalmente, se remarca la crítica al debilitamiento de fundar y motivar porque con ello no sólo se afecta el ejercicio del control difuso, también se condiciona la viabilidad del paradigma constitucionalista.es-ES
