DescriptionIn light of the decisions developed by the Mexican Supreme Court during the last years, this paper aims to show the ways in which the principle of consistent interpretation has run along different lines of reasoning, sometimes without a particular direction and some others towards a functional orientation. It also presents not only a chronological but also a political and legal evolution of this tool, and analyses the impact that some decisions have had in the Court’s legal thinking in order to achieve a more flexible and dynamic perspective about the constitutional interpretation of rights.en-US
DescriptionA la luz del trabajo jurisprudencial desarrollado por la Suprema Corte de Justicia de la Nación durante los últimos años, el presente texto aborda la manera en que la interpretación conforme ha transitado por caminos diversos, algunas veces sin rumbo fijo, y otras veces por rutas que pretenden su reorientación funcional. Para ello, expone la evolución que esta herra-mienta ha tenido no sólo de manera cronológica, sino también de manera más política y jurídica a la luz del impacto que ciertas decisiones han tenido en el devenir de la doctrina jurisprudencial de la Corte mexicana sobre este tema, y en especial en la transición hacia un pensamiento jurídico más flexible e innovador.es-ES
