The Inter-American Court of Human Rights declared on the need for a deeper analysis of the scope of Article 4.1 of the American Convention on Human Rights, given that the Court’s jurisprudence had not addressed the right of life at conception in a recent ruling against Costa Rica. The Court’s justices considered as inescapable the need to draft an interpretation of the terms “conception”, “person” and “in general” contained in the above mentioned Article 4.1. To reach such consensus, the justices analyzed the evolution of the international human rights protection framework as well as an exegesis according to the current use of such terms, in both the systematic and historical spheres of the Treaty’s purpose and objectives. The result was an interpretation based on solid arguments, supported by scientific evidence and free of dogma and religious influences.La Corte Interamericana de Derechos Humanos, en el fallo que se comenta, además de resolver a favor de los demandantes la controversia presentada en contra del Estado de Costa Rica, reflexionó sobre la conveniencia de analizar el alcance del artículo 4.1 de la Convención Americana para la Protección de los Derechos Humanos. Esto en virtud de que, al momento de emitirse la sentencia, la jurisprudencia de la Corte no se había pronunciado sobre el derecho a la vida desde su inicio. Los miembros de la Corte consideraron ineludible la tarea de realizar una interpretación legítima que precisara los conceptos: “concepción”, “persona”, “y en general”, contenidos en dicho artículo 4.1. Para lograr tal objetivo, procedieron al análisis de la evolución de los instrumentos internacionales de protección de los derechos humanos, y una exégesis conforme al sentido corriente de los términos, tanto sistemática como histórica, a la luz del objeto y fin del tratado. El resultado fue una interpretación con base en sólidos argumentos sustentados en una visión científica, alejada de dogmatismo y de influencias religiosas.
