DescriptionAccess to justice is one of the most important rights and guarantees to consider in the new constitutional transformation in Latin America and the Caribbean. Deepen his study in tax matters inevitably involves breaking into topics of high importance as the legal protection of the taxpayer front acts of the tax administration, and consequently, the need for judicial review of such acts or obstacles unhindered. Precisely in this article analyzes one of the limitations that restricts the content and scope of the jurisdictional guarantees, ie the solve et repete rule, privilege of public administration that lacks constitutional backing and leaves helpless to taxpayers.en-US
DescriptionLa tutela judicial es uno de los derechos y garantías más importantes a tener en cuenta en la nueva transformación constitucional de América Latina y el Caribe. Enrolarse en su estudio en materia tributaria implica ineluctablemente irrumpir en temas de trascendental importancia como resultan ser la protección jurídica del contribuyente frente a los actos de la administración tributaria, y consecuentemente, la necesaria revisión judicial de tales actos sin trabas u obstáculos. Precisamente en el presente artículo se analiza una de las limitaciones que restringe el contenido y alcance de las denominadas garantías jurisdiccionales, a saber, la regla solve et repete, privilegio de la administración pública que carece de respaldo constitucional y que hace ilusoria la defensa del contribuyentees-ES
