DescriptionIn the last years, the works about the validity of the international treaties before the Brazilian law, specially after the approval of the constitutional amendment 45/2004. However, there are a lot of questions that must be discussed regarding the procedures by means of a State express its consent to be bound by a treaty, because the Brazilian legal system presents serious deficiencies. Ratification is the act “whereby a State establishes on the international plane its consent to be bound by a treaty”; nevertheless the observation of the internal procedures that precede the international ratification and the role played by the Executive and Legislative powers has such relevance; denunciation is included in the competences of the Brazilian. In conclusion, some suggestions are presented aiming the amelioration of the Brazilian constitutional system and the solution of its lacks concerning the ratification and the denunciation of treaties.en-US
DescriptionEn los últimos años han sido frecuentes los trabajos sobre la validez de los tratados internacionales en el derecho brasileño, especialmente después de la aprobación de la Enmienda Constitucional 45/2004. Sin embargo, hay muchas cuestiones que merecen ser discutidas y repensadas en lo tocante a la manifestación de la voluntad del Estado, puesto que el sistema jurídico brasileño presenta lagunas graves relacionadas con el treaty making power. La ratificación es un acto por el cual el Estado establece de modo definitivo su voluntad en el plano internacional; no obstante, hay que observar los procedimientos necesarios para realizar la “ratificación interna” y el papel ejercido por los poderes Ejecutivo y Legislativo; la denuncia es un acto por el cual el Estado cancela unilateralmente el cumplimiento de un tratado. Al final, se anotan sugerencias de corrección de algunas de las lagunas encontradas en el sistema constitucional brasileño en lo que respecta a la ratificación y la denuncia de los tratados.es-ES
