This article argues that the “economics and social clauses” of the Constitution to have analyzes since an theory of the constitutional norms that to gather type, normative structure and real efficacy, subject critic the doctrine of inspiration liberal and conservative negative of the normative efficacy of the clauses and specially the social rights.El artículo sostiene que las “cláusulas económicas y sociales” de la Constitución deben ser analizadas desde una teoría de las normas iusfundamentales que dé cuenta de su tipo, estructura normativa y real eficacia u operatividad, sometiendo a crítica aquella doctrina de cuño neoliberal y neoconservador que niega eficacia normativa a las cláusulas y en especial a los derechos sociales.
