| Description | Democracy, pillar of Latin American countries and cornerstone of their Constitutions, is in risk because of presidentialism, constitutionality and Welfare State. This one is the aspect that most concern the author because, even though Democracy Constitution establishes equality, justice and social rights in general, their effective protection is beyond by current changes, international economy and pace of globalization. As a solution to this problem, Constitutional Tribunal has played an essential role supporting social rights without concern of the State Structure or the economic plan. | en-US |
| Description | La democracia, fundamento de los Estados latinoamericanos y principio estructural de sus Constituciones, se ve amenazada por el presidencialismo, la constitucionalidad y el Estado social. Este último es el aspecto que más preocupa al autor, pues si bien es cierto que la Constitución democrática establece ideales de igualdad, justicia y derechos sociales en general, su efectiva protección es rebasada por la realidad cambiante, la injerencia de la economía internacional y los ritmos de la globalización. Ante esta problemática el Tribunal Constitucional ha desempeñado un papel esencial al privilegiar los derechos sociales sin tener cuidado de la estructura del Estado o la planeación económica. | es-ES |
