DescriptionThis contribution deals with three levels of analysis. First, the author evaluates to what sense democracy is a conceptual rule referring to a specific form of production in constitutional system. Thus, democracy -as a matter of procedure- is based on the idea people is the only holder of constituent power, because democracy is a government in the name of the people. So, the sovereignty comes from down, from individuals who at the time they are citizens they integrate the Nation. Second, supporting National Constitution as the way of democratic power renewed among generations, this is not a matter of linguistic questions or good behavior. The conception of constituent power has a vital practical relevance. Within that context, if democracy needs to be protected by Constitution, it should be analyzed from the structural point of view constitutional system in Argentine solves its claims of immanence and importance by interval of the guarantees, elements anticipated for the endorsement of its rules. The third, if analysis of the parts of the Constitution evidence that interpretation -via judicial review of legislation- and reform are irreplaceable pieces for their maintenance and/or change, is pertinent to describe mechanisms which make work these elements.en-US
DescriptionEl autor escribe su contribución en tres niveles de análisis. Primero, evalúa en qué sentido puede especularse que democracia es una regla conceptual referida a una forma específica de producción del sistema constitucional. Así, democracia -como cuestión de procedimiento- queda conectada con la idea de que no hay otro titular del poder constituyente más que el pueblo, porque democracia es gobierno ejercido en nombre del pueblo. Desde esta perspectiva, la soberanía viene de abajo, de los individuos que, en tanto ciudadanos, componen el pueblo. Segundo, postular que la Constitución Nacional es el cauce de un poder democrático renovado intergeneracionalmente, no constituye una cuestión lingüística ni de buenos modales. El concepto de poder constituyente tiene una vital relevancia práctica. Dentro de este contexto, si la democracia necesita ser protegida por la Constitución, se analiza desde el punto de vista estructural cómo resuelve el propio sistema constitucional argentino sus pretensiones de inmanencia y trascendencia por intermedio de las garantías, elementos previstos para el respaldo de sus reglas. Tercero, si el análisis de la colección de partes de la Constitución evidencia que la interpretación -vía control judicial de constitucionalidad- y la reforma son piezas insustituibles para su mantenimiento y/o cambio, es pertinente describir los mecanismos que hacen funcionar estos elementos.es-ES
