DescriptionThe historical process of Latin America over the past twenty years has resulted in an opening up to democracy in the majority of its countries, and in an overall or partial reform of their Constitutions, characterized by an insertion of the basic rights of the human being. Nevertheless, and despite all the efforts made, this process has been slow and not always free from the old defects of the region, such as domination by political bosses, domination by the military and an extremity of poverty and wealth. Faced by this problem, Constitutional dogma and justice must review the source of their doctrine for the purpose of assigning a priority role to basic rights in the strengthening of the Latin American Constitutional State.en-US
DescriptionEl proceso histórico de América Latina en los últimos veinte años ha traído consigo la democratización de la mayoría de sus países, así como la reforma total o parcial de sus Constituciones, caracterizada por la inserción de los derechos fundamentales del ser humano. No obstante, y a pesar de todos los esfuerzos realizados, este proceso ha sido lento y no siempre ha estado exento de los antiguos vicios de la región como el caudillismo, el militarismo y la extrema riqueza y pobreza. Frente a este problema, la dogmática y la justicia constitucionales deben revisar sus fuentes doctrinarias para otorgar a los derechos fundamentales un papel prioritario en el fortalecimiento del Estado constitucional latinoamericano.es-ES
