DescriptionThe author engages in a study of part of the Argentine Constitution, as amended in 1994, known as the "Economic Constitution". Once the rules of a formal Constitution are recognized as legal and as "law", binding and relating everything contained therein with economic and financial activities, with resources and expenses, and with the Public Treasury, then these must become subordinate to the Constitution. Far from representing a separate and independent environment, the economic Constitution confers efficiency as regards rights and the Constitutional institutions, covering social, economic and cultural rights and any others to be enjoyed, and the exercise of any favorable and functional socioeconomic conditions. This Constitutional regulation of economic-financial matters must be kept very much in mind for the purposes of public policy, always in accordance with what is today called a social and democratic State of law.en-US
DescriptionEl autor aborda el estudio de parte de la Constitución argentina reformada en 1994 y conocida como "Constitución económica". Una vez que las normas de la Constitución formal quedan reconocidas como jurídicas y como "derecho" que obliga y vincula, todo cuanto en ella se relaciona con la actividad económica y financiera, con los recursos y los gastos, y con la hacienda pública, debe subordinación a la Constitución. Lejos de componer un ámbito separado o independiente, la Constitución económica confiere efectividad a los derechos y a las instituciones constitucionales. En ella se insertan los derechos sociales, económicos y culturales, así como aquellos derechos que necesitan para disfrute y ejercicio de los condicionamientos socioeconómicos que resulten favorables y funcionales. Las políticas públicas deben tener muy en cuenta esta regulación constitucional de lo económico-financiero, siempre a tono con lo que hoy se denomina Estado social y democrático de derecho.es-ES
