DescriptionIn Argentina, the Executive Branch has an exclusive jurisdiction in matters of foreign relations, a role that is developed by the Ministry of Foreign Affairs and Worship. In particular, this state agency is responsible for maintaining contact with the foreign diplomatic and consular representatives, accredited in the country. In exercise of this power, it must act as an intermediary of the notifications and communications between state officials and foreign missions, including those sent to and from the Judiciary. However, various judicial precedents provide a glimpse of a relative ignorance of this principle, or its improper application. On these parameters, the paper analyzes the formal procedure to exchange communication and notifications between the Judiciary and the foreign diplomatic and consular missions, through a detailed study of the law and jurisprudence.en-US
DescriptionEn Argentina, el Poder Ejecutivo Nacional posee una competencia exclusiva en materia de relacionamiento exterior, función que es desarrollada por el Ministerio de Relaciones Exteriores y Culto. En particular, esa dependencia estatal se encarga de mantener contacto con los representantes diplomáticos y consulares extranjeros, acreditados en el país. En uso de esta facultad, debe actuar como intermediario de las notificaciones y comunicaciones entre los funcionarios estatales y las misiones extranjeras, incluyendo aquellas remitidas desde y hacia el Poder Judicial. Sin embargo, diversos antecedentes jurisprudenciales permiten entrever un relativo desconocimiento de este principio, o su aplicación de forma inadecuada. Sobre estos parámetros, el artículo analiza el procedimiento formal para intercambiar comunicaciones y notificaciones entre el Poder Judicial y las misiones diplomáticas y consulares extranjeras, a través de un estudio pormenorizado de la legislación y jurisprudencia nacional.es-ES
