| Description | Payment default is a key concept in tort law. In 1968, the 17.711 Act, which amended the Civil Code, involved a major change in how debtors fall in payment default. In this paper, we intend to analyze the Section 509 of the Civil Code that deals with the subject: its writing as much as the solutions it establishes for different sorts of debtor-creditor relationships. Although the topic has been very much discussed – and long ago, a new discussion seems plausible facing a possible replacement of the whole Argentinean Civil Code. The regulation of the matter in the bill is also examined. | en-US |
| Description | La mora es una institución jurídica fundamental del Derecho de la responsabilidad civil. La regulación de la constitución en mora, requisito para que ésta se configure, sufrió una modificación radical en 1968 a través de la reforma del Código Civil por la ley 17.711. En este trabajo, se propone el análisis del art. 509 del Código Civil que aborda la materia, tanto en su técnica legislativa como en las soluciones que establece para los distintos tipos de obligaciones. Aunque el tema ha sido profusamente discutido –y hace muchos años–, un nuevo debate resulta plausible en la antesala de una posible reforma integral del cuerpo de Derecho Civil argentino –cuya regulación de la constitución en mora es también examinada–. | es-ES |
