The article analyzes and makes a balance on the constitutional reform of 1994. Starts out from the idea that constitutional reform is not a negative element but it shows the health of the system itself. Concludes that the constitution amended in 1994 is a “non-effective” constitution, either by deficiencies in policy formulation, or because executive Power has delegate too much power to the Congress. It is also understood that with respect to constitutional power, unfortunately the anatomy was not altered. With the excuse of congressional modernization and transfer of powers, everything was left untouched.El artículo realiza un análisis y balance sobre la reforma constitucional de 1994. Parte de la idea de que la reforma constitucional no es un elemento negativo sino que demuestra la buena salud del propio sistema. Concluye que la constitución reformada en 1994 es, en gran medida, una constitución inactuada, ya sea por deficiencias en la formulación normativa, o por entregar parte del poder constituyente al poder constituido congreso. Además, entiende que con relación al Derecho constitucional del Poder, lamentablemente no se alteró la anatomía que la precedió. Con la excusa de la modernización congresual y la transferencia de atribuciones, todo quedó en forma semejante.
