The article analyzes the use and access to water in the contemporary agrarian social structure of an Argentine NW population located at 1,885 m.s.n.m. It is a geographical space where since the eighteenth century population settlement and agriculture were based on watering plots deriving water from the river, by a superficial and non-impermeable net of ditches. Since the 1990s, the tax promotion of intensive agricultural production of wine-growing estates that irrigated by drips (tax deferrals) first and mining by foreign direct investment -I- then made possible the private appropriation of groundwater. FDI mining consumes groundwater for its workers, for the production process and as a means of transporting the mineral. The article shows how access to and use of groundwater had several consequences on the social structure: it contributed to the concentration of land ownership, the impoverishment of local smallholders (among whom there was a significant return of migrant women with children) and introduced locally 2 dimensions associated with its commercialization: quality and flow, absent until then in the reciprocity between irrigators, necessary to keep the ditch system operational. The conclusion of the research suggests the need to rethink state regulation in order to guarantee the right to water, considering that to think of nature as a subject of rights is a way of influencing distributive equity.El artículo realiza un análisis del uso y acceso al agua en la estructura social agraria contemporánea de un pueblo del NO argentino ubicado a 1.885 m.s.n.m. Se trata de un espacio geográfico donde desde el siglo XVIII el asentamiento poblacional y la agricultura se basaron en regar parcelas derivando agua del río, por una red superficial y no impermeable de acequias. Desde la década de 1990, la promoción impositiva de producción agrícola intensiva de latifundios vitícolas que riegan por goteo (diferimientos impositivos) primero y de la minería por inversión extranjera directa –IED- después, posibilitaron la apropiación privada del agua subterránea. La minería IED consume agua subterránea para sus trabajadores, para el proceso productivo y como medio de transporte del mineral. El artículo muestra cómo el acceso y uso del agua subterránea tuvieron varias consecuencias sobre la estructura social: contribuyendo a la concentración de la propiedad de la tierra, a la pauperización de los minifundistas locales (entre quienes tuvo lugar un significativo retorno de mujeres migrantes con hijos) e introduciendo localmente 2 dimensiones asociadas a su mercantilización: la calidad y el caudal, ausentes hasta entonces en la reciprocidad entre regantes, necesaria para mantener operativo el sistema de acequias. La conclusión de la investigación sugiere la necesidad repensar la regulación estatal de forma de garantir el derecho al agua, considerando que pensar a la naturaleza como sujeto de derecho es una forma de incidir en la equidad distributiva.
