DescriptionThe objective of this paper is to analyze and understand the role of the ju-diciary, in an environmental litigation presented by a group of Indigenous Associa-tions in the province of Chaco, Argentina. In it, not only the preservation of the na-tive forest but also the different forms of valuation, use, management and appropria-tion of the native forest from the intervention of different subjects in the litigation is at stake. In this context, given the topical-rhetorical nature of discourse and legal rea-soning (Santos, 1977), I am interested in analyzing the basic premises under which the dispute is created and framed by the different intervening subjects. This will allow us to inquire about the idea of damage construction and the notion of sustaina-bility that each of the subjects wield.en-US
DescriptionEl objetivo de este trabajo es analizar y comprender el rol del poder judicial, en un litigio de carácter ambiental presentado por un conjunto de Asociaciones Indígenas en la provincia de Chaco, Argentina. En él, se pone en juego no sólo la preservación del bosque nativo sino también las diferentes las formas de valoración, uso, manejo y apropiación del bosque nativo a partir de la intervención de distintos sujetos en el litigio. En este contexto, dado el carácter tópico-retórico del discurso y del raciocinio jurídico (Santos, 1977) interesa analizar las premisas básicas bajo las cuales la disputa es creada y enmarcada por los distintos sujetos intervinientes. Esto permitirá indagar acerca de la idea de construcción de daño y de la noción de sustentabilidad que cada uno de los sujetos esgrime.es-ES
