This paper addresses the complicated issue of the historical-dogmatic reconstruction of the governmental juridical statute of the Low Roman Empire, regarding only the criteria that ruled the recruitment and promotion of the administrative personnel of low and high hierarchy. In fact, such a statute can be only hypothesized, since the available sources, in particular constitutions under imperialisms, show the non-restricted nature of the hierarchical rules as well as the lack of calling in them supposedly present in all juridical regulations, uniformity and generality. From Constantine to Justinian, rules were established, often oscillating and barely objective, even subject to the discretional power of the head of service in order to discipline the entry to and promotion of the positions in the imperial Administration, revealing by then a strong bureaucracy. Besides, the need for such criteria was not perceived per se in the politi­cal power but rather as a mere vehicle leading to the eradication of a social phenomenon, a widely spread practice, which steadily used to buy off the offices and positions in the Administration.El presente trabajo aborda la complicada cuestión de la reconstrucción histórico-dogmática del estatuto jurídico funcionarial del Bajo Imperio Romano, sólo respecto a los criterios que regían el reclutamiento y promoción del personal admi­nistrativo de alta y baja escala. En efecto, el citado estatuto sólo es hipotizable, puesto que el material documental a nuestro alcance, fundamentalmente, constituciones bajo imperiales, muestra el carácter no taxativo de las reglas jerárquicas, así como la ausen­cia en ellas de la vocación que se supone presente en toda norma jurídica, uniformidad y generalidad. Desde Constantino hasta Justiniano fueron fijadas reglas, a menudo oscilantes y escasamente objetivas, incluso sometidas al poder discrecional del jefe del servicio, para disciplinar el ingreso y ascenso en los puestos de la Administración imperial, ya por entonces, fuertemente burocratizada. Por otra parte, la necesidad de tales criterios no fue sentida per se desde el poder político, sino más bien como mero Advervehículo conducente a la erradicación de un fenómeno social, práctica muy difundida y consistente en comprar los puestos y cargos de la Administración.
