This paper aims to carry out a critical analysis of the inheritance rights that the Spanish legal system grants to the surviving spouse from a comparative perspective of Italian law, in the context of current social reality. Specifically, it is proposed that the desire to protect the surviving spouse should not be detrimental to the deceased’s freedom of disposition.Este trabajo pretende realizar un análisis crítico de los derechos sucesorios que el ordenamiento jurídico español concede al cónyuge viudo desde una perspectiva comparada con el Derecho italiano y en el contexto de la realidad social actual. Específicamente se plantea que el deseo de proteger al cónyuge supérstite no debería ir en detrimento de la libertad de testar del causante.
