This article will review the process of debates and consensus that have been built over the last decades regarding four fundamental issues: i. the responsibility that companies have under international human rights law; ii. the universal application of these responsibilities —beyond their place of origin or the place where their activities are carried out— and the range of rights that these responsibilities encompass; iii. the duty of States to prevent, punish and remedy abuses committed by companies to the detriment of people, communities and/or the environment; and, finally, iv. Given the transnational nature of the problem, the need to monitor and ensure that the behavior of companies, beyond their national borders, conforms to the requirements imposed by their obligation to respect human rights.En el presente artículo se pasará revista al proceso de debates y consensos que se han ido construyendo a lo largo de las últimas décadas respecto de cuatro cuestiones fundamentales: i. la responsabilidad que las empresas tienen en virtud del Derecho internacional de derechos humanos; ii. la aplicación universal de estas responsabilidades —más allá de su lugar de origen o el de realización de sus actividades— y la gama de derechos que estas responsabilidades abarcan; iii. el deber de los Estados de prevenir, sancionar y remediar los abusos que las empresas cometan en perjuicio de las personas, las comunidades y/o el medio ambiente; y, finalmente, iv. la necesidad de que, dado el carácter transnacional del problema, se monitoree y asegure que el comportamiento de las empresas, más allá de sus fronteras nacionales, se ajuste a los requerimientos impuestos por su obligación de respetar los derechos humanos.
