| Description | The application of the most favourable rule or regime in labour law is not as simple as its name suggests. Different rules, criteria and assumptions have to be assessed in each case, which makes it difficult to find the most favourable rule. In this sense, this paper offers a guide to address and find an answer to this problem. However, the author argues that before determining what is to be understood by "more favourable rule", certain preliminary questions need to be clarified, such as (i) the hierarchy of norms, (ii) the imperative force of norms, (iii) the concurrence of norms, and (iv) the principle of the "minimum rule". Once all these points are understood, it will be possible to analyse their interrelationship and in this way to find the "operative mark" of the most favourable rule. In conclusion, although there is no infallible method or single way of determining the most favourable rule, the author argues that any method can be valid, but this will always depend on the legislation of each country and other factors that are analysed in detail in this work. | en-US |
| Description | La aplicación de la norma más favorable o la del régimen más favorable en el derecho laboral, no es una tarea tan sencilla como su nombre lo indica. Deben valorarse diversas normas, criterios y presupuestos en cada caso, lo que termina dificultando su hallazgo. En ese sentido, el presente trabajo ofrece una guía para abordar y encontrar una respuesta a esta problemática. No obstante, el autor sostiene que, antes de determinar lo que debe comprenderse por “norma más favorable”, primero deben dilucidarse ciertas cuestiones previas, tales como: (i) la jerarquía normativa, (ii) la fuerza imperativa de las normas, (iii) la concurrencia normativa y (iv) el principio de “norma mínima”. Una vez comprendidos todos estos puntos, se podrá analizar su interrelación y, de este modo, encontrar el “marca operativo” de la norma más favorable. En suma, aunque no exista un método infalible ni una única forma para establecer la norma más favorable, el autor plantea que cada método puede ser válido, pero ello siempre dependerá de la legislación de cada país, y de otros factores que son ampliamente analizados en el presente trabajo. | es-ES |
