DescriptionThe Truth and Reconciliation Commission published its final report on 28 August 2003. This report covers a wide range of issues, but focuses particularly on the process of bringing to justice cases of human rights violations such as extrajudicial executions, forced disappearances, torture, rape, arbitrary detention, and other crimes. In this context, this paper examines the problems encountered in the process of bringing to justice cases of human rights violations that occurred in Peru between 1980 and 2000. The author points out that amnesty laws, the statute of limitations, the role of the armed forces, states of emergency and the scope of habeas corpus cannot be used as obstacles to the truth. On the contrary, they must serve as instruments that do not undermine human rights in addition to protecting constitutional assets. Despite the progress that has been made, it is essential to strengthen the judicial investigation of these crimes in order to identify and punish the perpetrators and thus overcome the sense of impunity that prevails in the country. Legal institutions must therefore facilitate this process and act as a link to truth and justice, rather than as an obstacle to progress in these cases.en-US
DescriptionLa Comisión de la Verdad y Reconciliación emitió su Informe Final el 28 de agosto de 2003. Dicho informe abarca una variedad de puntos; sin embargo, se centra especialmente en el proceso de llevar ante la justicia casos de violaciones a los derechos humanos tales como las ejecuciones extrajudiciales, desapariciones forzadas, torturas, violaciones, detenciones arbitrarias, entre otros delitos. En ese marco, el presente trabajo aborda los problemas que se han ido superando en el proceso de judicialización de casos de violaciones a derechos humanos ocurridos en el Perú durante los años 1980 a 2000. De esta manera, el autor señala que las leyes de amnistía, la prescripción de los delitos, el papel de las Fuerzas Armadas, los estados de emergencia y los alcances del hábeas corpus, no pueden ser empleados como obstáculos hacia la verdad. Por el contrario, deben servir como instrumentos que, además de proteger bienes constitucionalmente relevantes, no pueden menoscabar los derechos humanos. A pesar de los progresos, es crucial reforzar la investigación judicial de estos crímenes para poder identificar y castigar a los culpables, y así superar la sensación de impunidad que ha prevalecido en el país. Por lo tanto, las instituciones jurídicas deben facilitar este proceso, actuando como conexiones hacia la verdad y la justicia, en lugar de ser barreras que impidan el avance en estos casos.es-ES
