| Description | In Roman Law, the classification of property into movable and immovable has responded to a criterion of mobility corresponding to the nature and physical characteristics of things. On the other hand, in the old French Law, the classification criterion was mainly based on an economic criterion, in which the value, the duration and the possibility of the goods to produce income periodically predominated. With the implementation of the French Civil Code (1804), the division between movable and immovable property acquired universality, being repeated in almost all Western legislations. However, in this paper we recognize that this classification has certain shortcomings, especially because it doesn’t meet all current requirements. Thus, its ineffectiveness is criticized, as well as the ineffectiveness of Peruvian legislation because it’s based on it. In this line, it’s proposed to replace this classic classification, based on the usefulness that these rights and/or goods have for society, duly organizing the guarantees, so necessary in a credit-based economy. | en-US |
| Description | En el Derecho Romano, la clasificación de los bienes en muebles e inmuebles ha respondido a un criterio de movilidad correspondiente a la naturaleza y característica física de las cosas. Por su parte, en el antiguo Derecho Francés, el criterio de clasificación radicó principalmente en uno de contenido económico, en el que predominó el valor, la duración y la posibilidad de los bienes de producir rentas periódicamente. Con la implementación del Código Civil Francés (1804), la división entre bienes muebles e inmuebles adquirió universalidad, repitiéndose en casi todas las legislaciones occidentales. No obstante, este trabajo reconoce que esta clasificación tiene determinadas deficiencias, sobre todo porque la misma no satisface todos los requerimientos actuales. De tal modo, se critica su inoperancia, así como la ineficacia de la legislación peruana por tener su base en ella. En esa línea, se propone sustituir esta clásica clasificación, en función a la utilidad que estos derechos y/o bienes tengan para la sociedad, organizando debidamente las garantías, tan necesarias en una economía basada en el crédito. | es-ES |
