DescriptionThis article offers an analysis of the evolution of the legal protection of the fundamental rights of the individual, from the 1933 Constitution to the promulgation of the 1979 Constitution. It begins with a critique of the 1933 Constitution and the 1936 Civil Code, which did not have an organic and systematic regulation of the fundamental rights of the individual, nor a clear definition of their relationship with the State and society. Influenced by philosophical currents such as existentialism and Marxist humanism, a theoretical development of the concept of the person began in the 1940s. This personalist approach was reflected in the proposed reform of the Civil Code in 1965, culminating in the draft of the First Book “Of Persons” in 1967. Subsequently, the 1979 Constitution marked a significant change by explicitly recognizing the person as the supreme purpose of society and the State, establishing fundamental rights and a vision of work as a social right and duty. In addition, it promoted the compulsory teaching of the Constitution and human rights. Based on all this, the author celebrates this Constitution as a milestone in Peruvian history, by integrating personalist principles that place the person at the center of the legal system, promoting a just and supportive society.en-US
DescriptionEl presente artículo ofrece un análisis de la evolución de la protección jurídica de los derechos fundamentales de la persona en el Perú, desde la Constitución de 1933 hasta la promulgación de la Constitución de 1979. Inicia con una crítica a la Constitución de 1933 y al Código Civil de 1936, que no tenían una regulación orgánica y sistemática de los derechos fundamentales de la persona, ni una definición clara de su relación con el Estado y la sociedad. Luego, por la influencia de corrientes filosóficas como el existencialismo y el humanismo marxista, a partir de la década de 1940, se inició un desarrollo teórico de la persona. Este enfoque personalista se reflejó en la propuesta de reforma del Código Civil en 1965, culminando en el proyecto del Libro Primero "De las Personas" en 1967. Posteriormente, la Constitución de 1979 representó un cambio significativo al reconocer explícitamente a la persona como el fin supremo de la sociedad y del Estado, estableciendo derechos fundamentales y una visión del trabajo como un derecho y deber social. Además, promovió la enseñanza obligatoria de la Constitución y los derechos humanos. Partiendo de todo ello, el autor celebra esta Constitución como un hito en la historia peruana, al integrar principios personalistas que sitúan a la persona en el centro del ordenamiento jurídico, promoviendo una sociedad justa y solidaria.es-ES
