This article provides a comprehensive view of the 1979 Constitution of Peru, highlighting its focus on the duties of the State, the form of the State, the concept of labor, sovereignty, social constitutionalism, and how these elements shape the Peruvian political legal framework. Along these lines, the author first focuses on the definition and meaning of the "form of the State", differentiating it from the "form of government". Having delimited this, through excerpts from the constitutional text, he presents the duties of the State, such as the promotion of general welfare, justice, and the elimination of exploitation, reflecting the ideological character of the norm. In this regard, the author discusses the concept of work and presents it as a right and a social duty. On the other hand, he also explores the characteristics of the Peruvian State, defined as representative democratic, social and decentralist unitary, and discusses the classification of the States as unitary or federal, and the distinction between them. Likewise, the article examines the principle of sovereignty, especially popular sovereignty with its limitations, together with social constitutionalism and the incorporation of social and economic rights, which seek to transform liberal democracy into social democracy. With all this in mind, the author reviews the broad recognition of social rights in the Constitution, covering issues such as family, social security, health, education and labor.El presente artículo brinda una visión integral de la Constitución de 1979 del Perú, destacando su enfoque en los deberes del Estado, la forma del Estado, el concepto de trabajo, la soberanía y el constitucionalismo social, y cómo los elementos configuran el marco jurídico político del país. En esa línea, primero el autor se centra en la definición y el significado de la “forma del Estado”, diferenciándola de la "forma de gobierno". Delimitado ello, a través de extractos del texto constitucional, presenta los "deberes" del Estado, tales como la promoción del bienestar general, la justicia, y la eliminación de la explotación, reflejando el carácter ideológico de la norma. Al respecto el autor discute el concepto de trabajo y lo presenta como un derecho y un deber social. Por otro lado, también explora las características del Estado peruano, definido como democrático representativo, social y unitario descentralista, y aborda la clasificación de los Estados en unitarios o federales, y la distinción entre ellos. Asimismo, el artículo examina el principio de soberanía, especialmente la soberanía popular con sus limitaciones, junto con el constitucionalismo social y la incorporación de derechos sociales y económicos, los cuales buscan transformar la democracia liberal en social. Con todo ello, el autor realiza una revisión del amplio reconocimiento de derechos sociales en la Constitución, que abarcan temas como la familia, seguridad social, salud, educación y trabajo.
