DescriptionThis article analyzes the emergence and evolution of transfuguism, as well as its structure and characteristics, from a legal perspective. The author argues that it is crucial to recognize the foundations and elements of this phenomenon. Although it is not possible to assume an illicit or criminal nature of this figure, it can generate states of anomie within the framework of political institutionality. The author suggests that a defector's desire to change political parties is influenced not only by personal factors, but also by the political environment and relationships within the new political group. Therefore, to prevent the anomie that comes with political party switching, it is suggested that citizens and political leaders take a deliberate stance against the culture of self-interest and individual gain, and instead prioritize the common good and civic responsibility.en-US
DescriptionEl presente artículo analiza el escenario en el que emerge y evoluciona el transfuguismo, así como su estructura y características, desde una perspectiva jurídica. En su análisis, el autor argumenta que es crucial reconocer los fundamentos y elementos de dicho fenómeno, y aunque no cabe asumir un carácter ilícito o delictivo de esta figura, puede generar estados de anomia en el marco de la institucionalidad política. En esa línea, el autor sugiere que el deseo del tránsfuga, esto es, un político que cambia de partido, no es solo una decisión personal, sino que también se encuentra influenciado por el entorno político y las relaciones que se efectúan en el interior de los grupos políticos a los que se une. En consecuencia, para controlar la anomia asociada con el transfuguismo se propone que los ciudadanos y líderes políticos adopten una postura consciente, que se oponga a la cultura centrada en el beneficio personal e individualista, y se apueste por una actitud que valore el bienestar colectivo y la responsabilidad cívica.es-ES
