The rights have diverse variables for his application, two of them are: the force and the territory. But what happens with the constitutional laws of the persons when they are located abroad, they must be protected from the same way when one resides in the country or out of the same one, or perhaps these diminish. This work analyzes the validity, the recoverableness and the limits of the fundamental rights of the persons out of the country.Los derechos tienen diversas variables para su aplicación, dos de ellas son: la vigencia y el territorio. Pero qué pasa con los derechos constitucionales de las personas cuando se localizan en el extranjero, se deben proteger de la misma manera cuando se reside en el país o fuera del mismo, o acaso se reducen estos. Este trabajo analiza la validez, la exigibilidad y los alcances de los derechos fundamentales de las personas fuera del país.
