Description	An in-depth exploration of punishment throughout Peruvian history serves as a crucial foundation for understanding and potentially enhancing the prison system. This article aims to scrutinize the historical trajectory of custodial sentencing in Peru. Leveraging accounts from chroniclers, compilations of the Laws of the Indies, and historical studies, the analysis unfolds across three distinct historical periods: the Inca justice system, colonial-era prisons, and challenges encountered during the Republic Era. Through this examination, the article seeks to elucidate any significant shifts within the prison system across these epochs. Finally, it provides insights into the primary factors contributing to the shortcomings of the penitentiary system.	en-US
Description	El conocimiento integral de la punición en la historia peruana permitirá entender el régimen carcelario y posibilitar sus mejoras. El objetivo del presente artículo es el análisis histórico de la pena privativa de la libertad en el Perú. Para este fin, se utilizaron los testimonios de cronistas, la recopilación de Leyes de Indias y los estudios dejados por historiadores. En ese sentido, se desarrollan tres momentos históricos: el sistema de justicia incaico, las cárceles en la colonia y la problemática durante la República. En este contexto, se desarrollan estas etapas para poner de relieve si existe algún cambio importante en el sistema penitenciario. Por último, se da cuenta de las razones principales que señalan el fracaso del sistema penitenciario.	es-ES
