DescriptionThe paper examines the status of the Southern Ocean in the context of the Antarctic Treaty and the Law of the Sea Convention, highlighting recent interest in its valuable natural resources, such as krill, which represent economic potential but also pose environmental challenges. This ocean, delimited by the Antarctic Convergence, benefits from protections established in the Antarctic Treaty, which promotes scientific research and the peaceful and cooperative use of the region, without resolving the territorial claims of several countries. For its part, the New Convention on the Law of the Sea is concerned with establishing zones of sovereignty, such as the Exclusive Economic Zone, generating new tensions over jurisdiction in Antarctic waters. These tensions have divided States into three positions: countries with territorial claims, those that consider the area as High Seas and those that seek to protect the region as a Common Heritage of Mankind. Finally, despite these conflicting positions, the author emphasizes the need and importance of harmonizing both treaties in order to preserve the environment and ensure peaceful cooperation in the region.en-US
DescriptionEl trabajo examina la situación del Océano Austral en el contexto del Tratado Antártico y la Convención sobre el Derecho del Mar, destacando el interés reciente por sus valiosos recursos naturales, como el krill, que representan un potencial económico, aunque también plantean desafíos ambientales. Este océano, delimitado por la Convergencia Antártica, se beneficia de protecciones establecidas en el Tratado Antártico, el cual promueve la investigación científica y el uso pacífico y cooperativo de la región, sin resolver las reclamaciones territoriales de varios países. Por su parte, la Nueva Convención sobre el Derecho del Mar se ocupa de establecer zonas de soberanía, como la Zona Económica Exclusiva, generando nuevas tensiones sobre la jurisdicción en aguas antárticas. Estas tensiones han dividido a los Estados en tres posiciones: los países con reivindicaciones territoriales, los que consideran el área como Alta Mar y los que buscan proteger la región como Patrimonio Común de la Humanidad. Finalmente, a pesar de estas posiciones enfrentadas, el autor enfatiza la necesidad e importancia de armonizar ambos tratados a fin de preservar el medio ambiente y garantizar la cooperación pacífica en la región.es-ES
