The present paper analyses the recent judgment of the Court of Justice of the European Union in the Brisch case. The reference for preliminary ruling concerns the optional or mandatory nature of the application form established by the Succession Implementing Regulation for the issue of an European Certificate of Succession. The present paper tackles the general framework, from the current CJEU’s case law on the Succession Regulation’s provisions on the ECS, to the main procedural issues. Then, an analysis of the case and of the CJEU’s reasoning is offered. The concluding remarks submit some considerations on the impact of the standard forms established by the EU Regulations within the civil judicial cooperation.; Il presente contributo analizza la recente sentenza Brisch della Corte di giustizia dell’Unione europea. La domanda di pronuncia pregiudiziale verte sulla natura del modello di domanda di emissione del certificato successorio europeo, previsto dal regolamento di esecuzione del regolamento sulle successioni transfrontaliere. Pertanto, il contributo affronta lo stato attuale della giurisprudenza della Corte di giustizia sul certificato successorio europeo e le regole procedimentali fondamentali per il suo ottenimento. Quindi, è analizzato il caso con particolare attenzione alla motivazione della Corte. Infine, le conclusioni presentano alcune considerazioni più generali sul valore e sugli effetti dei moduli standard, previsti nei regolamenti dell’Unione in materia di cooperazione giudiziaria civile.; Il presente contributo analizza la recente sentenza Brisch della Corte di giustizia dell’Unione europea. The article focuses on the impact of time limits on the free circulation of judgments rendered in absentia in civil and commercial matters within the EU. Starting from the Lebek judgment, I will examine the following issues: first, if an application for relief from the involuntary expiry of time limits may justify the denial of recognition and enforcement of judgments under the regime of the Brussels I bis Regulation; second, if the defendant applying for relief may choose between the time limit laid down in the service Regulation or that provided for in national law. Finally, I will address the question of the possible standardisation of the deadline for the first reaction on the part of the defendant.; Lo scritto concerne l’impatto esercitato dai termini processuali sulla libera circolazione di sentenze contumaciali rese in materia civile e commerciale nell’ambito dell’Unione Europea. Partendo dall’analisi della sentenza Lebek vengono evidenziate talune questioni. Innanzitutto, ci si chiede se la richiesta di restitutio in integrum che il convenuto proponga a seguito dall’involontario spirare dei termini, possa giustificare il mancato riconoscimento e l’esecuzione di una sentenza nell’ambito del Regolamento Bruxelles I bis; si affronta, poi, il problema se il convenuto che domandi la rimessione in termini abbia facoltà di scelta tra il termine contemplato dal Regolamento No 1393/2007 e quello previsto dal diritto nazionale. Infine, si delinea la possibile standardizzazione nel diritto processuale civile europeo del termine per la comparsa del convenuto.

The CJUE judgement of 19 September 2018, Hampshire County Council v C.E., N.E., In Joined Cases C-325/18 PPU and C-375/18 PPU, responds to questions for a preliminary ruling, which have as a fundamental issue the protection of the child’s interests, that prevails in front of any subject, in this case in front of the local authority responsible for the protection of children, of the United Kingdom. In this case, the CJEU is in favor of a court of a Member State being able to take preventive measures against the public body of another Member State, so that it cannot continue or initiate an adoption procedure.; La Sentencia TJUE, de 19 de septiembre de 2018, Hampshire County Council contra C.E. y N.E, asuntos acumulados C 325/18 PPU y C 375/18 PPU, responde a cuestiones prejudicial, que tienen como cuestión fundamental de fondo la protección del interés del menor, que prevalece frente a cualquier sujeto, en este caso frente a la autoridad local responsable de la protección de la infancia, de Reino Unido. En este caso, el TJUE se muestra a favor de que un Tribunal de un Estado miembro pueda adoptar medidas cautelares contra el citado organismo público, de otro Estado miembro, con objeto de que no pueda seguir o entablar un procedimiento de adopción.

This judgement by the Supreme Court resolves an application for review of sentence based on the ground for opposition referred to in Article 510.4º of the Code of Civil Procedure (CCP): an unfair judgement caused by malicious conduct. The plaintiff intentionally concealed and distorted the information about defendant’s domicile; as a result, the judgment was given by default. The Court did not examine the substantive matter and declares the expiration of the review action, because more than three months had passed since the fraud was discovered (Art. 512 CCP). Before the procedure in Spain an identical process was taking place in New Jersey (USA). The question that arises is how a second process could be opened in Spain while the first was pending. The answer lies in a well-known institution of Private International Law: forum shopping.; Se solicita la revisión, ex art. 510.4º LEC, de una sentencia de divorcio ganada injustamente en virtud de maquinación fraudulenta, al ocultar y falsear intencionadamente el actor los datos del domicilio de la esposa demandada, declarada en situación de rebeldía procesal. El TS no entra en el fondo del asunto, al declarar la caducidad de la acción de revisión, por haber transcurrido más de tres meses desde el descubrimiento del fraude (art. 512 LEC). Antes del proceso desarrollado en España, se sustanciaba en Nueva Jersey (EE.UU.) un procedimiento con el mismo objeto y entre las mismas partes. Pese a lo cual, el marido presenta en una segunda demanda de divorcio ante el Juzgado de Primera Instancia, donde realiza el fraude descrito. Surge la cuestión de cómo pudo abrirse en España un segundo proceso estando pendiente el primero. La respuesta está en una institución sobradamente conocida en el Derecho internacional privado: el forum shopping.
