The Nascent Mexican Labor Law: 1891-1928; El naciente derecho laboral mexicano: 1891-1928
This essay shows the ideological and doctrinal sources that prepared the way for the so-called social constitutionalism in Mexico since the end of the 19th century. Very close to the current European social issue, the Mexican liberals discussed the protection of workers and the dignity of work, disclosing free recruitment and free exercise of the profession enacted at the old article 5 of the Constitution of 1857, from subordinated and salaried work of the new article 123 of the Constitution of 1917. A mixture of libertarian and Catholic ideas and some other external influences led to the foundational and controversial debate of registering as a constitutional norm, the protection of the social and economic rights of the manufacturing and agricultural workers, which snatched judicial control, in civil matters, (which was common in other countries of America) of lawsuits arising from the recruitment, permanence and dismissal of workers, which passed to the scope of the Conciliation and Arbitration Boards under the control of the revolutionary executive of 1917. The essay shows, with original and little consulted sources, that the ideological and doctrinal influences that were behind the writing of the article of work in Mexico were in some times against the attribution of judicial law, the Amparo, in hands of the Mexican Supreme Court, despite the fact that the executive power maintained until the current reforms of 2018-2019, the control of those conciliation and arbitration boards. With the reforms of 1928 and the first Federal Labor Law of 1931, labor matters became a norm of political control of the executive power, inaugurating a kind of mass politics and unions control managed by General Cárdenas government (1934-1940).It also highlights the strong influence of the libertarian and anarchist ideas of the political newspaper Regeneration of Ricardo Flores Magón in the doctrinal body of section VI of the new article 123, which the literature known until today tends to insinuate more from the Catholic perspective of Rerum Novarum.; El artículo muestra las fuentes ideológicas y doctrinales que prepararon el camino al llamado constitucionalismo social en México desde finales del siglo XIX. Siguiendo de cerca las corrientes de la cuestión social europea, los liberales mexicanos discutieron la protección de los trabajadores y la dignificación del trabajo. Así, pasaron del principio de la libre contratación y ejercicio de la profesión que emanaba del antiguo artículo 5 de la Constitución de 1857 al del trabajo subordinado y asalariado del nuevo artículo 123 de la Constitución de 1917. Una mezcla de ideas libertarias y católicas e influencias externas desembocó en el debate fundacional y controvertido sobre registrar como norma constitucional la protección de los derechos sociales y económicos de los trabajadores manufactureros y agrícolas. Ello arrebató a la justicia jurisdiccional, en materia civil, (como era común en otros países de América) el control judicial de los pleitos derivados de la contratación, la permanencia y el despido de los trabajadores, que pasó al ámbito de las Juntas de Conciliación y Arbitraje bajo control del ejecutivo revolucionario de 1917. El ensayo muestra, con fuentes originales y poco consultadas, que las influencias ideológicas y doctrinales que estuvieron detrás de la redacción del artículo del trabajo en México estuvieron a contracorriente de la atribución de interpretación por la vía del amparo que tuvo la Suprema Corte de Justicia de la Nación (SCJN) de México, a pesar de que el poder ejecutivo mantuvo, hasta las reformas actuales de 2018-2019, el control de la conciliación y del arbitraje. Con las reformas de 1928 y la primera Ley Federal del Trabajo de 1931, la materia laboral se convirtió en una norma de control político del ejecutivo, e inauguró la política de masas y control sindical de la etapa del General Cárdenas (1934-1940). Resalta también la fuerte influencia de las ideas libertarias y anarquistas del ideario político Regeneración, de Ricardo Flores Magón, en el cuerpo doctrinal de la fracción VI del nuevo artículo 123, influencia que la literatura conocida hasta hoy suele insinuar más desde la mirada católica de la Rerum Novarum.

Juridical Traditions and Oeconomic Survival in a Constitutional Genealogy. The Case of Tucumán in 1820; Tradiciones jurídicas y pervivencias oeconomicas en la genealogía constitucional. El caso de Tucumán en 1820
The nineteenth-century Spanish-American constitutionalism was inextricably related to the emancipatory process. The constitutional texts sought to establish limits to public powers that were forming in the independent territories, in mined paths of crossroads on which the newest historical and legal studies are elucidating motivations and objectives. From there, it is being discovered that constitutional projects did not ignored a four-hundred-yearold public order, but incorporated elements, subjects and above all, purposes: what is the objective of putting functions and limits to a public power separate from the domestic sphere? Can we trace the survival of an old domestic order —oeconomic— in the constitution, social and political order that should not be confused with the colonial fact? Therefore, it is important to periodize the constitutional journey, since although in the final products, the constitutions that came into force in the nascent Latin American States, the traces of an old mentality are not easily discernible, in the earliest projects they were not only the view but they were determinants in the definition of the subject of law and in the values —catholic, oeconomic— that had to be protected. The nineteenth-century Spanish-American constitutionalism was inextricably related to the preeminent place of the Spanish householder, catholic and land owner. On nineteenth-century Spanish-American constitutionalism, the prescriptive capacity of the catholic economy has weighed, like a sword of Damocles, for the determination of juridical principles.To highlight this hypothesis, it is necessary to perform an almost archaeological tracking of concepts and themes in the first debates on the fundamental law and the resulting texts. For this, we have chosen a provincial constitution, that of the province of Tucumán, written in 1820. Located halfway between the Peruvian space and the River Plate, Tucumán wanted to insert itself in the debate on the formation of the State by dictating its own constitution, as cover letter for a game of powers that was yet to be defined.; El constitucionalismo hispanoamericano del siglo XIX estuvo relacionado inextricablemente con el proceso emancipatorio. Los textos constitucionales que buscaron establecer límites a unos poderes públicos que se estaban formando en los territorios independientes tuvieron trayectorias minadas de encrucijadas. En relación con estos textos, los más nuevos estudios históricos y jurídicos están dilucidando motivaciones y objetivos. A partir de allí, se está descubriendo que los proyectos constitucionales no hicieron tabla rasa sobre un orden público cuatro veces centenario, sino que incorporaron elementos, sujetos y, sobre todo, finalidades: ¿cuál es el objetivo de poner funciones y límites a un poder público separado de la esfera doméstica? O, dicho a la inversa, ¿se puede rastrear la pervivencia de un antiguo orden doméstico —oeconomico— en las cartas magnas, orden social y político que no debe ser confundido con lo colonial? Para eso es importante periodizar el trayecto constitucional, ya que, si bien en los productos finales —las constituciones que entraron en vigencia en los nacientes Estados latinoamericanos— los rastros de una mentalidad antigua no son fácilmente discernibles, en los proyectos más tempranos no solo estuvieron a la vista, sino que fueron determinantes en la definición del sujeto de derecho y en los valores —católicos, oeconomicos—que se debían resguardar. Sobre el constitucionalismo hispanoamericano del siglo XIX ha pesado, como una espada de Damocles para la determinación de principios jurídicos, la capacidad preceptiva de la oeconomia católica.Para arrojar luz sobre esta hipótesis, es necesario realizar un rastreo casi arqueológico de conceptos y temas en los primeros debates sobre la ley fundamental y en los textos resultantes. Para ello, hemos elegido una constitución provincial, la de la provincia de Tucumán, escrita en 1820. Ubicada a mitad de camino entre el espacio altoperuano y el rioplatense, Tucumán quiso insertarse en el debate sobre la formación del Estado dictando su propia constitución, como carta de presentación para un juego de poderes que estaba aún por definirse.

The treatment of the relicta pia (pious bequests assigning temporal goods to the purpose of salvation of the soul) in Nueva Granada in the eighteenth and nineteenth century, where properly studied according to its own dogmatic (a juridical one, originated in the Western canon of Roman descent), provides the opportunity to rethink the idea of secularization itself, as a form of transmission of material, juridical and political resources (land, iurisdictio), along the transition from the ancien régime to constitutional and legalist republics. The notion of «spiritual» or «spiritualized» goods, placed outside the commercium, among which land must be possibly included, as object of pious dispositions, refers to sacrum, the sacred, as an «antineutral» dimension of politics, law and justice; this dimension originates in the pignora of the pagan religio, a pactist and communitarian one, and lingers on in Christian relicta and relics, described and interpreted according to the set of concepts, principles and institutions of the ius commune, Roman and canonical, plural and casuistical; a system far from all blunt identification with the «law of the Catholic Monarchy», and whose rule continues for decades after the establishment of Republics in Hispanic America. In its effort to create modern «property», Bourbon laws intervene against customary and immaterial forms of gaining and circulating rights on land, neutralizing dispositives of the ancient sacrum, so announcing the transition of law to an abstract dimension, tending to depoliticization, due to legalism and positivism. The liberal State rising triumphant from the revolutions will eventually displace politics, previously established in rendering justice, to new territories, temporarily coextensive with the domains of (political) economy.; El tratamiento de los relicta pia (disposiciones de última voluntad que destinan bienes a instancias de salvación del alma) en los siglos XVIIIXIX neogranadinos, siempre que se evalúe según su dogmática propia (la jurídica, determinada por el canon occidental de ascendencia romana), ofrece la oportunidad de repensar la idea misma de «secularización», como forma de transmisión de recursos materiales, jurídicos y políticos (tierra, iurisdictio) en la transición del antiguo régimen a las repúblicas constitucionales y legalistas.La noción de bienes «espirituales» y «espiritualizados», sustraídos al commercium, noción que incluye posiblemente, por vía de disposiciones pías, la tierra, nos remite al sacrum como dimensión «antineutral» de la política, el derecho y la justicia; esta dimensión se origina en los pignora de la religion pagana, comunitaria y pactista, y perdura en los relicta y reliquias cristianos, descritos e interpretados según el aparato conceptual, institucional y preceptivo del ius commune, romano y canónico, plural y casuista, que, lejos de identificarse tout court con el «derecho de la Monarquía católica», resiste en la América hispana a lo largo de muchas décadas de su historia republicana.En el esfuerzo para crear la moderna proprietarietas, la legislación borbónica interviene formas consuetudinarias e inmateriales de la adquisición y circulación de derechos sobre tierra, con lo que neutraliza dispositivos del antiguo sacrum y anuncia el tránsito del derecho a una nueva dimensión, abstracta y tendiente a la despolitización (en cuanto legalista y positivista). El Estado liberal que surge triunfante de las revoluciones termina desplazando la política, anteriormente asentada en el impartir justicia, hacia nuevos territorios, coincidentes en primer lugar, de momento, con el dominio de la economía (política).

This paper refers to the historical evolution of the favor debilis principle from the Roman Law until our days. In this way, it begins with an examination of the favor libertatis principle and its incidence on the debtor’s responsibility, as well as the contractual interpretation in Ancient Rome. Subsequently, it refers to the incidence of Christianity in the moralization of the obligation. Then, the text refers to the persistence of the favor debilis under the modern model based on the conception of a free man that is able to protect its rights. Finally, its persistence in postmodernity is analyzed, which suggests changes in the law of obligations and contracts, which proposes also a new moralization of the contract, but sustained this time in the fundamental rights, as well as a renewed anthropocentric vision. Then, it refers to the bases of rules more favorable to the consumer and ends with the revision of the functions of the pro consumer principle: interpretation and conflict resolution mechanism of standards.; El trabajo aborda la evolución histórica del principio del favor debilis desde el derecho romano hasta llegar a nuestros días. De esta manera, se examina el favor libertatis y su incidencia en la responsabilidad del deudor, así como la interpretación contractual en la Antigua Roma, y se indican, además, los textos que le pueden servir de fuente. A continuación, se revisa la incidencia de la aparición del cristianismo en la moralización de la relación jurídica, el cual pretende lograr un equilibrio entre el deber de cumplimiento y la humanización de la deuda. Luego, el texto se refiere a la persistencia del principio comentado bajo el modelo moderno, fundamentado en la concepción de un hombre libre y capaz de resguardar sus derechos. Finalmente, se analiza su persistencia en la posmodernidad, que critica duramente al régimen anterior, y sugiere cambios en el derecho de obligaciones y de contratos. Así, se tiende a una nueva propuesta de moralización de la relación jurídica, pero sustentada esta vez en los derechos fundamentales, así como en una renovada visión antropocéntrica. En este punto, se realiza una especial referencia al derecho de consumo, y se indica el fundamento del establecimiento de reglas más favorables al consumidor. Luego de ello, se revisan dos de las más importantes funciones que hoy cumple dicho fundamento: la interpretación y el mecanismo de resolución de conflictos de normas.
