The text of the article 60 of the Constitutional Law of Human Rights and its Guarantees of Mexico City requires an interpretation that harmonically adjusts its content not only to the rights and needs of the evicted, but also of the right holders on the claimed property. In this work a punctual reading of the first section of this article is made and it is demonstrated that the term “launch” is unduly used in the text, which requires a restrictive interpretation.; El texto del artículo 60 de la Ley Constitucional de Derechos Humanos y sus Garantías de la Ciudad de México requiere una interpretación que ajuste su contenido armónicamente no sólo a los derechos y necesidades de los desalojados, sino también de los titulares del derecho sobre el inmueble reclamado. En este trabajo se hace una lectura puntual de la primera sección de este artículo y se demuestra que en el texto se ocupa indebidamente el término “lanzamiento”, que requiere de una interpretación restrictiva.

This article explains clearly and succinctly the procedure mentioned in both The Hague Convention on the Civil Aspects of International Child Abduction and the Inter-American Convention on the International Return of Children. In the same way, the antecedents of the international abduction of minors and their basic concepts are treated, so, with this, we can understand in what constitutes an international restitution, and the cases in which they can be given in a generic way. Likewise, the number of cases that have been generated in our country, the treatment that has been given to them and where they have been initiated are exemplified, whit this, reader can understand that the phenomenon of the abduction of minors is not a particular aspect of our country, it is a situation that, due to globalization, is becoming more common every day, for which States have the obligation to provide the necessary measures to prevent give the same and, in any case, if it was given, provide a fair procedure and according to the needs of the children.; El presente artículo explica de manera clara y sucinta el procedimiento que mencionan tanto la Convención de La Haya sobre los Aspectos Civiles de la Sustracción Internacional de Menores como la Convención Interamericana sobre Restitución Internacional de Menores. De igual manera, se tratan los antecedentes de la sustracción internacional de menores y sus conceptos básicos, a fin de que se pueda comprender en qué consiste una restitución internacional, así como los casos en los que se puede dar de manera genérica. Asimismo, se ejemplifican el número de casos que se han venido generado en nuestro país, el trato que se les ha dado y en dónde se han iniciado los mismos, pudiendo con ello el lector comprender que el fenómeno de la sustracción de menores no se trata propiamente de un aspecto particular de nuestro país, sino que, por el contrario, es una situación que, debido la globalización, cada día es más común, por lo cual los Estados tienen la obligación de brindar las medidas necesarias para evitar que se dé el mismo y, en todo caso, si ya se dio, se proporcione un procedimiento justo y acorde a las necesidades de los menores.

The present article deals with three psychic disabilities, derived from the third paragraph of canon 1095 of the current Code of Canonic Law. The first of these, the canonists have baptized it as “The lack of sufficient psychic capacity for the canonical nuptials”; the second is called “inability to fulfil marital obligations since the beginning of ecclesiastical marriage”, and the third is called “inability for the community of life and love for marriage”. The document studies the main canonical lines on which these disabilities work in ecclesiastical courts. Each disability has its own characteristics and specific nature. They include —in canonical procedural scope— the questions that the judge of the church must subject the actor and/or the agreed, summoned or defendant. The text is enriched with the most advanced doctrine authorized by the magisterium in this delicate and transcendent matter. The questions have fine points that make the difference between interrogation for the actor and for the witnesses of the cause. The roman jurisprudence also takes its place and the foreign bibliography is specialized.; El presente artículo trata sobre tres incapacidades psíquicas para matrimoniarse, derivadas del parágrafo tercero del canon 1095 del actual Código de Derecho Canónico. La primera de ellas, los canonistas la han bautizado como “la carencia de suficiente capacidad psíquica para las nupcias canónicas”; la segunda se denomina “incapacidad para cumplir obligaciones matrimoniales desde el inicio del matrimonio eclesiástico”, y la tercera se llama “incapacidad para la comunidad de vida y amor para el matrimonio”. El documento estudia las principales líneas canónicas sobre las cuales trabajan estas incapacidades en sede de tribunales eclesiásticos. Cada incapacidad tiene sus características y su naturaleza propia. Se incluyen —en el ámbito procesal canónico— las preguntas que el juez de la Iglesia debe someter al actor y/o a la convenida, convocada o demandado(a). El texto está enriquecido con la más avanzada doctrina autorizada por el magisterio en esta delicada y trascendental materia. Los cuestionamientos tienen puntos finos que hacen la diferencia entre el interrogatorio para el actor(a) y para los testigos de la causa. La jurisprudencia romana también toma su sitio y la bibliografía extranjera es especializada.

The guiding principle of the Mexican Inheritance Law indicates that “when a person dies all its heritage is passed on to their successors”. However, this principle has exceptions, that is to say, there are goods that even when they form part of the assets of the author of the succession, are not necessarily transmitted to their successors or assigns, which does not mean that those goods are not transmitted by cause of death. An exception is in financial matters and refers to the designation of beneficiaries in contracts celebrated with certain financial institutions whose object is money, securities or stocks. Another exception is in agrarian matters with regard to ejidal rights. In this work is studied the various possible scenarios in the legal practice including such exceptions; especially, considering that in both cases, it may be a testamentary disposition.; El principio rector del derecho sucesorio mexicano indica que “a la muerte de una persona todo su patrimonio se transmite a sus sucesores”. Sin embargo, dicho principio tiene excepciones; es decir, hay bienes que aun cuando forman parte del activo patrimonial del autor de la sucesión, no se transmiten forzosamente a sus sucesores o causahabientes, lo cual no significa que no se transmitan por causa de muerte. Una excepción es en materia financiera, y se refiere a la designación de beneficiarios en contratos celebrados con ciertas entidades financieras, cuyo objeto sea dinero, títulos o valores. Otra excepción se da en materia agraria respecto a derechos ejidales. En este trabajo se estudian los diversos escenarios posibles que en la práctica jurídica encierran esas excepciones; sobre todo, considerando que en ambos casos se puede tratar de una disposición testamentaria.
